  1. Call to Order
    The meeting was called to order at 6:00 pm by Mayor Jim Murphy.

    1. Roll Call

      Present: Mayor Jim Murphy, Mayor Pro-Tem Bill Powers, Councilmember Leah Turner, Councilmember Mikki Battaglia, Councilmember Pat Morton

      Staff Present: City Manager Ryan Bonk, Finance Officer Susan Scarlett (Zoom), City Attorney Steve Gross (Zoom), Solid Waste Consultant Tom Valentino (Zoom)

    1. City Council Communications

      Councilmember Battaglia: Attended Railroad Days and 5k event, Board of Supervisors meeting

      Councilmember Morton: Attended Railroad Days, Beckwourth Peak Fire Protection District meeting

      Mayor Pro Tem Powers: Attended Railroad Days

      Mayor Murphy: Attended Railroad Days, grand opening of Box Car, discussed email from Truckee City Council member that requested a member of City Council to participate in a collaborative effort with various communities. Councilmember Battaglia agreed to participate on behalf of the City along with the City Manager.

    2. Reports: Beckwourth Peak Fire Protection District / Plumas County Sheriff / Northern Sierra Air Quality 

      Beckwourth Peak Fire Protection District: No report. City Manager Bonk stated the organization assisted with boil water notices handed out yesterday and thanked them for their efforts.

      Plumas County Sheriff's Office: Sheriff Hermann and two sergeants provided an update. Sheriff discussed the success of the collaborative effort to remove abandoned and unregistered vehicles throughout the County and City. Thanked Intermountain Disposal and Brian Attama for their assistance with the effort. 

      Sergeant Hermann discussed "Trunk or Treat". 

      Council and Sheriff discussed emergency alert system.

      Northern Sierra Air Quality: Final two weeks of Green Waste disposal. 

    3. Staff Communications

      None

    4. City Manager Report

      City Manager Bonk provided an update on the Gulling Street Bridge riprap work that was recently completed. Staff has reached out to Caltrans to perform an underwater dive inspection. Administrative Services Manger was hired.

  4. Consent Agenda
    1. Claims:

      Adopt Resolution No. 2626. The resolution authorizes payment of payroll from September 6th, 2025 through September 19th, 2025 and accounts payable from September 25th, 2025 through October 8th, 2025

      The amount of payroll to be paid is $43,354.79

      The amount of accounts payable to be paid is $121,112.22

      The total amount to be paid is $164,467.01

    2. Minutes

      Adopt the minutes of the September 24, 2025 Regular City Council Meeting.



    Councilmember Pat Morton motioned to approve. Councilmember Leah Turner seconded the motion.

  5. Intermountain Disposal - Rate Increase

    Solid Waste Consultant Tom Valentino provided the City Council with the staff report. Mayor Murphy requested that the staff report content be provided during the Proposition 218 process. Councilmember Turner stated that the City rates are cheaper then the County rates. 

    City Attorney Gross discussed changes in law regarding Proposition 218.

    Council voted to direct staff to commence the Proposition 218 process.

    Councilmember Mikki Battaglia motioned to approve. Mayor Pro-Tem Bill Powers seconded the motion.

  6. City Councilmember Resignation & Filling the Vacancy

    Councilmember Turner announced resignation from City Council effective at the end of the day on 10/14/2025. 

    Mayor Murphy presented Councilmember Turner with a Certificate of Recognition.

    City Attorney Gross discussed the City Council's opportunity to fill the vacancy. Councilmembers asked various questions of City Attorney Gross. City Manager Bonk confirmed the timeline with the Council. 

    City Attorney Gross commented on the Council’s legal ability to make the appointment. He said that the law would prohibit the Council from filling the vacancy by appointment if the appointment would result in a majority of the Council members being appointed rather than having been elected. He stated further that while several of the current Council members have been appointed to office at some time, all have been elected after having been appointed so they may fill this vacancy by appointment.

    City Council voted to fill the vacancy by appointment. 

    Councilmember Pat Morton motioned to approve. Councilmember Mikki Battaglia seconded the motion.
